These terms and conditions include general terms and conditions for use of this Site, terms and conditions relating to the services provided by Optimum Health and Sports Performance Ltd on the Site and in our facility. Your use of the Site, the purchase of any Products or Services on this Site or in our Facility will be subject to these terms and conditions. And you now hereby agree to our Terms and Conditions. If you access and use this web site (the “www.ohsp.co.uk or www.optimumh.co.uk”), you accept and agree to be bound by and comply with these terms (the “Terms”). If you do not accept the Terms, please do not use the Site. We reserve the right to change our Terms and Conditions so it is the users’ responsibility to check them regularly.
Optimum Health and Sports Performance Ltd may change these Terms and Conditions from time to time. By browsing the Site, you are accepting that you are bound by the current Terms and Conditions. You should check these each time you revisit the Site. These Terms and Conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.
These Terms and Conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
Sessions are always subject to availability but we at Optimum Health and Sports Performance Ltd will always do our best to accommodate you. All contracts and monthly packages must be prepaid and you agree to our 24hr notice policy when cancelling and/or rescheduling. If you’re booked into a session, but miss it or cancel with less than 24 hours’ notice, you will be charged for it.

Information displayed on the Site or in our facility as to pricing and availability is subject to change by Optimum Health and Sports Performance Ltd without notice.
All payments are to be completed through Optimal Payments.
Important Liability Statement
The information available on or through this Site, and the Services supplied via or in connection with this Site or at the Optimum Health and Sports Performance Ltd facility do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor. It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this web site (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by us to you. You, your legal representatives and your heirs release waive, discharge and covenant, not to sue Optimum Health and Sports Performance Ltd and its trainers for any injury or death caused by their negligence or other acts.
All clients are required to sign a liability waiver before personal training sessions can commence.
Health Commitment Statement (HCS) Form
All clients are required to complete a HCS form before personal training sessions can commence to help determine the safety or possible risk of exercising based on their answers to specific health history questions.
Optimum Health and Sports Performance Ltd warrants that the Products and Services will be supplied with reasonable skill and care.
Statutory Rights and Refunds and Cancellation
The Client shall not transfer sessions to any other person or permit them to be used by anyone other than the Client’s. Any assignment, transfer or disposal of courses is at the sole discretion of Optimum Health and Sports Performance Ltd and may only be permitted in exceptional circumstances. Contract and monthly packages fees are non refundable. Any booked sessions must be cancelled within 24 hours, in person or by telephone. In any other case, the session will be charged and deducted from the remainder of the Client’s package. When you are purchasing contacts or packages you are paying for a session and not a trainer. Trainers are subject to change without notice. The rights of cancellation and refund and any limitation expressed in these Terms and Conditions do not affect your statutory rights as a consumer. Refunds in relation to Products or Services may only be credited to the credit or debit card linked to the account originally used to make the purchase. An administration fee of £75.00 is applicable.
In these Terms and Conditions, the following definitions apply:
“Services” means any information and services ordered and/or provided by Optimum Health and Sports Performance Ltd through or via the Site or our facility and all services offered as part of any course or workshop. Any electronic information supplied to you by Optimum Health and Sports Performance Ltd will constitute part of “Service” not a Product and cancellation rights will apply accordingly. “Products” means any products offered for sale on the Site or in the Optimum Health and Sports Performance Ltd facility.

Suspension and termination of Service
Optimum Health and Sports Performance Ltd may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Please note, Free Returns applies to UK MAINLAND ONLY. Returns are subject to Optimum Health and Sports Performance Ltd Refunds and Returns Policy. Some consumable items cannot be returned unless sell by date has been reached on receiving your goods.
How can I exchange an Item?
In the event of your merchandise requiring exchange, such as a different size or faulty product please contact our Customer Service Team via the online Contact Page.

How long does it take to process my refund?
Once your goods are back at Optimum Health and Sports Performance Ltd, your refund will be processed. Please allow 5-7 days for the refund to reach your account.
What happens if I have received a faulty item?
If you’re having trouble with your new product or believe it is defective, please call Optimum Health and Sports Performance Ltd on 0203 700 3101 immediately to report your defective product.
What if my invoice was not shipped with my order?
Please contact Optimum Health and Sports Performance Ltd if your invoice has not been received within 14 days of your order being delivered, you should receive an invoice by e-mail.
Depending on the weight and value of your order, Optimum Health and Sports Performance Ltd will select Postal or Carrier Delivery for the most suitable delivery method. You can find the delivery method for your order within your order acknowledgement email. For carrier deliveries a signature may be required and you can track the status of your order in My Account. For postal deliveries a signature may also be required and order status tracking is again available via My Account. Please note that we do not ship to P.O. boxes or BFPO addresses. Delivery times vary according to your selected delivery address and availability of your items. You can also find delivery costs at checkout, on the Order Confirmation email and online when you view your order in My Account.
We keep you informed Shortly after you place your order by credit or debit card, you will receive an order acknowledgement email to confirm that we have received your order. Once your order has been accepted and dispatched you will receive a dispatch notification email confirming that your order has been processed. This email contains your order details, carrier and tracking information. If ordering as a gift, you may wish to provide your own email address and not the address of the recipient. Please make sure that the email address on your order is correct and that the email has not been directed to a spam folder. You can track your order by clicking My Account at the top of the page and selecting Track an Order.
Delivery date information
The items on your order will ship as soon as they become available. In-stock items will ship within 48hrs of receipt of your orders. Orders received after 11am on Friday or during the weekend, are not processed until the next working day. Excluding Bank Holidays. Changes to your order Once your order has been prepared for dispatch or has been dispatched, we may be unable to change the delivery address. Tracking your order
For carrier deliveries you can track the status of your order via online My Account 24 hours a day, 7 days a week. To track your order, click My Account at the top of the page and select the order in question On the My Account page you can view the current status of your order, view the items ordered, and track your delivery.
Problems with your order
Missed Carrier Delivery: If you are not at home when the carrier attempts to deliver your order, the carrier will leave a card. You can contact the carrier directly for a new delivery appointment during working hours at a suitable date and even amend your delivery address. If your order has passed the scheduled delivery date in your dispatch notification email, please contact Optimum Health and Sports Performance Ltd Customer Service. We will investigate with the appropriate carrier and strive to deliver your order as soon as possible.
Postal Delivery: If you are not at home for a postal delivery or your order cannot be delivered, a card with collection details will be left for you. In most cases, you can collect your order from the Postal Delivery Office where it is being held and you may be able to arrange a redelivery. You can track your order by clicking My Account at the top of the page and selecting Track an Order. If your order is being delivered by the postal service and you have not received it 15 days after dispatch, please contact Optimum Health and Sports Performance Ltd Customer Service.
Damaged or defective orders: If you have received your order and find that it is damaged, please call Optimum Health and Sports Performance Ltd Customer Service. In case of any damage to your delivery, Optimum Health and Sports Performance Ltd will be in direct contact with the carrier to resolve the issue as quickly as possible with as little inconvenience to you. We will make every effort to contact you and keep you informed of the progress of our investigation and where appropriate, deliver a replacement. If you’re having trouble with your new Optimum Health and Sports Performance Ltd product or believe it is defective, please call Optimum Health and Sports Performance Ltd Customer Service immediately.
Missing Invoices: Within 3-5 days of your order being delivered, you should receive an official Optimum Health and Sports Performance Ltd invoice by e-mail. If you do not receive this invoice or if you require an additional copy for your records, you will be able to print your invoice on our My Account section of the website. If you have further questions about VAT, please call Optimum Health and Sports Performance Ltd Customer Service.
If your order has not yet been dispatched, you can cancel your order by calling our Customer Service Desk at 0203 700 3101. If your order is preparing for shipment or already in transit, please wait for your order to be delivered before initiating the return on our Order Status website or by contacting Optimum Health and Sports Performance Ltd Customer Service. Please note that you may be liable for a return transportation charge.
